However, we reserve the right (from time to time) to restrict access to the website to allow essential maintenance or upload new services and/or improvements. Product Availability

All products for sale on eshopare subject to availability. If for any reason your order cannot be fulfilled owing to lack of stock, we will process a refund for the out of stock item(s) and will let you know.

Part Delivery

If only part of your order is available, we will dispatch the items that are in stock and cancel the out-of-stock items.

Product Descriptions

Every product is sold subject to the product description and supporting information such as size, colour, estimated delivery dates and guarantees. All sizes are in UK standard sizes (Size Guide). We make every effort to ensure that the product colour is as accurate as possible, but the colours shown may vary depending upon the setting of your computer monitor. We cannot guarantee that the colour shown will accurately reflect the colour upon delivery. We will take all reasonable care to ensure that all of the product details, descriptions and prices are correct at the time when the information was uploaded onto the website. However, the information may not always exactly reflect the position when you placed an order. Please note that the estimated delivery times are only estimates, and cannot be guaranteed. Packaging may vary from that shown. We reserve the right to refuse orders where the product information, price or product promotion has been incorrectly published.

PRICES

All prices include VAT and are subject to change without prior notice.

The products will be at your risk from the time of delivery.

Ownership of the products will only pass to you when we receive full payment of all sums due in respect of the products, including delivery charges.

The price of any products will be as quoted on our site from time to time, except in cases of obvious error.

These prices, including VAT but excluding delivery costs, will be added to the total amount due as set out in the delivery information page.

Prices are liable to change at any time, but changes will not affect orders in respect of which we have already sent you in a Dispatch Confirmation.

Our site contains a large number of products and it is always possible that, despite our best efforts, some of the products listed on our site may be incorrectly priced. We will normally verify prices as part of our dispatch procedures so that, where a product’s correct price is less than our stated price, we will charge the lower amount when dispatching the product to you. If a product’s correct price is higher than the price stated on our website, we will normally, at our discretion, either contact you for instructions before dispatching the product, or reject your order and notify you of such rejection.

We are under no obligation to provide the product to you at the incorrect (lower) price, even after we have sent you a Dispatch Confirmation, if the pricing error is obvious and unmistakable and could have reasonably been recognised by you as a mis-pricing.

Promotional Terms & Conditions

We run promotions both in our stores and online http://www.eshops.co.uk/. Some of these promotions may be exclusively online, exclusively in-store or only available to customers in certain areas.

Discounted products available on eshophave been on sale at the higher marked price either on the web site or in at least one of our retail stores for at least 28 consecutive days in the last 6 months.

Eshops reserves the right to; cancel offers, refuse to allow any individual to participate in offers, decline to accept orders where, in its opinion, an offer code is invalid for the order being placed and amend these terms and conditions (eshops will use reasonable endeavors to notify changes to all customers).

Start rite shoes are excluded from any offers and promotions within the Isle of Man store.

 OUR CONTRACT

When you place an order with http://www.eshops.co.uk/, we will send you an order acknowledgement by email containing all the details of your order. This is NOT an order confirmation but an acknowledgement that your order has been received. Our acceptance of your order will take place when we send a dispatch confirmation email. Any products on the same order, which we have not confirmed in a Dispatch Confirmation email, will not form part of that contract.

We reserve the right to refuse an order. Non acceptance of an order may be as a result of one of the following, but not limited to: the product ordered being out of stock; our inability to obtain the authorisation for payment; the identification of an error within the product information, including price and promotion; you not meeting the eligibility to order as set out in the Terms and Conditions.

You are seeking to enter into a contract with Eshops Stores Ltd when you place an order.

Contract Cancellation

We hope that you will be entirely satisfied with your purchase. Should you wish to cancel your order, you have a right to cancel this contract within 14 days without giving any reason.

For sale of goods, the cancellation period will expire after 14 days from the day on which you (or your representative) acquire physical possession of the goods supplied.

To exercise the right to cancel, you must inform us at customercare@eshops.co.uk, of your decision to cancel this contract by a clear statement e.g.

If you cancel the contract, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us).

We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you.

We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You will have to bear the direct costs of returning the goods.

Credit, Debit, PayPal, Amazon & Apple Pay

We accept most major cards including Visa, MasterCard, Visa Debit, Switch/Maestro. Customers can also use PayPal, Amazon and Apple Pay to pay for orders. This is available as an option during checkout.

We are unable to accept payment via cheque or any method other than those listed above.

Gift Cards may be redeemed online or in store. You can find your nearest store by clicking our Store Finder.

E-Gift Card Terms & Conditions:

E-gift cards can be purchased and redeemed online at www.eshops.co.uk or at participating Eshops stores throughout the UK.

A minimum spend of £10 must be selected in order to purchase an E-gift card.

For in store use, you must print out the e-gift card and present it at the till or present a digital copy of it at the till.

The Eshops e-gift card is not accepted at any Eshops concession or stores outside the UK.

The balance on the e-gift card may be checked in store or by emailing customercare@eshops.co.uk.

If the gift card is not used within 24 months of the last transaction date, the gift card will expire and cease to have any value.

The e-gift card cannot be exchanged for cash.

No liability is accepted for loss of e-gift card information. Protect this e-gift card and treat it as cash.

Eshops reserve the right to amend the terms and conditions or discontinue the e-gift card at any time.

E-gift cards must not be used for resale. This does not affect your statutory rights.

Gift Cards

Your e-gift card is redeemable as full or part payment against any purchase in participating Eshops store or online at www.eshops.co.uk.

The Eshops Gift card is not accepted at any Eshops concession or stores outside the UK.

General

We will charge your card when your order is placed. If there are any items in your order that are not in stock, you will not be refunded. You will be advised by email if we are unable to complete your order for any reason. As part of our policy to protect against the fraudulent use of credit cards, we carry out random security checks on orders. These can take various forms, and may involve contacting you by telephone before your order is processed.

PRICES, TAXES AND PAYMENT

The website will charge and take payment in £ Pound Sterling. All prices shown on the site are inclusive of local UK (Value Added Tax) VAT at 20% and if you are in an EU country currently, this will be the price you pay. Orders for Non EU destinations will not be charged VAT and will have this deducted at checkout. Copy invoices are available from within your online account control panel. Simply login to your account for details.

Payment methods available include AMEX, Mastercard, VISA & PayPal, Amazon and Apple Pay .

We have introduced Verified by Visa and MasterCard SecureCode to give you even more confidence when shopping online.

These services give you extra protection against unauthorised usage when shopping online.

 EVENTS BEYOND OUR REASONABLE CONTROL

If we are delayed or are unable to fulfil our obligations under these Terms and Conditions as a result of events beyond our reasonable control (force majeure), including (but not limited to) strikes, lockouts, failures of third party systems, acts of god, fire, earthquake, storm, flood, natural disaster, civil unrest, acts of terrorism, deliberate damage to equipment or data, or damage of premises or equipment, we cannot be held responsible. This does not affect your statutory rights.

 LAW

This website, the content within it and any contract resulting from using it are governed by and construed in accordance with the Laws of Scotland and will be subject to the exclusive jurisdiction of the Scottish Courts. All contracts will be conducted in the English language.

Any student with a valid student card is entitled to 10% off their purchase in store. The card must display a valid expiry date, it must also display a photograph of the hold or signed by the holder or show the card holders name.
